1 Terms and Conditions
Welcome to www.familyallsorts.co.uk.  This website (“the Site”) is owned and operated by V&R Publishing Limited.
1.1 In these terms and conditions (“the Terms”) the following meanings shall apply:
 “we” “us” or “our” shall mean V & R Publishing Limited a limited liability company incorporated in England and Wales under registered company number 06598967
 “you” “your” or “users”  shall mean a reference to all users of the Site whether authorised by us or otherwise
 “the Site” shall mean the www.familyallsorts.co.uk website
Headings are for reference purposes only and in no way define limit construe or describe the scope or extent of such section.
1.2 Use of the Site is governed exclusively by the Terms and your continued use constitutes your agreement to be bound by the Terms which shall take effect immediately on your first use of the Site.  If you do not agree to be bound by all of the following Terms then please do not access use and/or contribute to the Site and you should forthwith cease to use the Site
1.3 We reserve the right to withdraw or amend any of the Terms at any time and without notice. As the Terms may change from time to time and all changes will be posted on the Site users are therefore advised that they should revisit the Terms from time to time.  If you continue to use the Site after amendments have been made you will be deemed to have accepted those amendments.
1.4 You agree to abide by the Terms at all times.  Any agreement by you not to do any act or thing also includes an agreement by you not to permit or allow the doing of that act or thing by another user.
2 Content
2.1 The content of the Site is intended for enjoyment and use by private individuals and is subject to change without notice. 
2.2 One of our aims is to provide information on family-related topics and issues which may be of interest to you and which will include content which is uploaded by us.  We reserve the right to refuse or remove any content on this Site.  We shall be under no obligation to remove or amend any content unless expressly required to do so by law.
2.3 As we do not upload all information contained within the Site we cannot ensure the accuracy of all information and to the fullest extent permitted by law we make no and expressly exclude all representations (except fraudulent misrepresentation) undertakings or warranties about any of the content of the Site including without limitation any liability as to the accuracy completeness quality or fitness for purpose of such content or goods available on the Site and further we cannot be held liable for any use or reliance you may make of or put on it.  By using the Site you acknowledge and accept that information and materials contained on this Site may contain inaccuracies or errors and we expressly exclude all liability in this regard. 
2.4 It shall be your own responsibility to ensure that any products services or information offered or made available on or through this Site meet your requirements.
2.5 If at any time you are dissatisfied with the content or accuracy of any information contained on this Site which is directly applicable to you or your business interests then please contact us immediately and we will use all reasonable endeavours to investigate your enquiry and make changes where necessary.
3 Intellectual Property
3.1 All copyright design graphics logos and text including the selection and arrangement thereof all patents trademarks and other intellectual property rights whether registered or unregistered in on or used by the Site and all software compilations underlying source code software and all other material on the Site are subject to copyright and other proprietary rights which are either owned by us or used strictly under licence from third party rights owners which may include other authorised users
3.2 Under no circumstances shall the use of this Site grant to any user any interest in any intellectual property rights including but not limited to copyright goodwill know-how trademarks or patents belonging to us or any third party whatsoever.  Any use of Site content without having first obtained our prior written consent shall be deemed to be an infringement of our rights and we reserve all rights in this regard.
3.3 You may not broadcast copy decompile disassemble download make available to the public post reproduce republish reverse engineer transmit or otherwise use the Site’s content in any way except for your own personal and for the avoidance of doubt for a non-commercial use. Any redistribution or reproduction of part or all of the contents in any form is strictly prohibited.
3.4 You hereby warrant not to adapt alter or create a derivative work from any Site content except in any case for your own personal and non-commercial use.
3.5 You may not except with our express written consent distribute or commercially exploit the content for monetary gain or otherwise. Further you may not transmit Site content or store it in any other website or other form of electronic retrieval system.
3.6 Notwithstanding the earlier provisions of this section you may print or download extracts for your personal and non-commercial use provided that you acknowledge us and our Site as the source of the material. 
4 Links
4.1 From time to time this Site may also include links to other websites.  Any link be it a hypertext link or other referral device used on the Site is provided solely for your use and convenience and without warranty as to content.  We have no control over and do not endorse nor are in any way responsible for the content of any such websites.
4.2 We assume no liability obligation or responsibility for any part of any correspondence dealing participation transaction or webcasting that you may enter into with the owners or users of any other website.
5 Membership
5.1 In order to fully access all services on the Site you may be required to create an account with a specific username and password.  If any of the services require you to create an account you must complete the registration process by providing us with accurate current and complete information as requested.
5.2 All passwords are to be treated by you as strictly confidential.  We will also treat your account details as confidential.  For further details please refer to our Privacy Policy as may be published from time to time.
5.3 You are solely responsible for all actions taken under that username and password assume all liability in this regard.  Where member access is required you shall only use the Site using your own username and password.
5.4 You must use your best endeavours to maintain the security and integrity of your password information and should not disclose it or permit it to be used by any other person.  You must notify us immediately if there is an unauthorised disclosure of your username and password or you suspect that security precautions regarding your password have been breached.
5.5 You may at any time not hold two or more user accounts on this Site without our prior consent.  Any attempt to do so including but not limited to falsifying user details to meet this end shall be deemed as a misuse of the Site and your use shall be immediately terminated.
5.6 If you use multiple logins for the purpose of disrupting any Site community or for the purpose of annoying other users you may have action taken against all of your accounts
5.7 If following a change to the Terms you wish to cancel any membership account that you have created you may do this using our membership termination procedure as may be published from time to time.
5.8 From time to time we may choose to introduce fees for some of the services provided on or by the Site.  We may at our sole discretion change some or all of our services at any time. In the event that we introduce a new service and we charge a fee for that service the fees will be effective and become payable at the launch of the service. Unless otherwise stated all fees are payable in GB Pounds sterling.  Whether you are a business or not value added tax (VAT) and other taxes may apply to your transaction as appropriate from time to time.  Users will be responsible for paying all fees associated with using our service and the Site and all applicable taxes.
6 Member Conduct
6.1 You are entirely responsible for all content that you upload to post on or otherwise transmit via this Site.  You understand that by using the Site you may be exposed to content that you may find offensive indecent or objectionable.  You further understand that this Site may contain notice-boards forums review sections and other interactive areas and you agree to use the Site in a way in good faith in a just and proper manner and in keeping with the general principles of the Site.
6.2 You agree that when using the Site you will not:
6.2.1 upload post or otherwise transmit any content that is any way abusive defamatory harmful harassing libellous obscene threatening vulgar unsavoury or unlawful;
6.2.2 upload post or otherwise transmit any content that you do not have a right to transmit under any law or any Content (or use the Site in any manner) which violates or infringes the rights of any person firm or company (including but not limited to rights of intellectual property rights of confidentiality or which may be intrusive of another person’s privacy).
6.2.3 upload post or otherwise transmit any content that contains any patent trademark copyright or other intellectual property rights of any party unless you own or control the rights thereto or have received all necessary permissions.
6.2.4 upload post or otherwise transmit any material that contains software viruses or any other files or programs that may interrupt destroy or limit the functionality of any of our site or sites or any servers networks connected to such V&R Publishing Site or another's computer or any chain letters pyramid-selling schemes bulk mail or mails bombs or other such programs.
6.2.5 upload post or otherwise transmit any unsolicited or unauthorized advertising promotional materials or any other form of solicitation.
6.2.6 restrict or in any way inhibit any other user from using the Site
6.2.7 use the Site in a manner that is inconsistent with these Terms and/or not in accordance with all relevant laws and regulations or for any illegal purpose.
6.3 Any content uploaded or in any way posted by you which we feel is of a nature which is incompatible with the general principles of the Site or which may inhibit our ability to effectively manage the Site may be removed by us and in addition if we feel it appropriate further action without limitation may be taken against you. 
6.4 Where you breach or where we suspect that you are in breach of the Terms or following any misuse or abuse of the Site we reserve the right (but shall not be required to) provide a warning to you for failure to comply.  We also reserve our right to disable any user identification code or password whether chosen by you or allocated by us and further to ban or exclude you from future use of the Site at any time whether or not any prior warning has been given.
6.5 Following any ban exclusion or prohibition from the Site we reserve the right to retain your ISDN and/or ISP information in order to ensure the effective and safe management of the Site.
6.6 You agree to indemnify and hold us and (as applicable) our parent subsidiaries affiliates officers directors agents and employees without liability from and against all liabilities including but not limited to damages (consequential or otherwise) direct or indirect losses costs and other expenses including professional fees resulting from any claim made by any third party due to or arising out of your breach or alleged breach of the Terms or your violation of any law or the rights of a third party arising out of your use of this Site.
6.7 Further you agree that in the event that you have any right claim or action against any other user arising out of that user's use of the Site then you will pursue such right claim or action independently of and without recourse to us save that you will seek to protect our interests at all times and shall not settle any claim where we may be joined as party without our prior written consent.
7 Notice-board and Forums
7.1 Except where a posting is made by us all notice-boards and forums contained within the Site are for the exclusive use of private individuals.  Except where we may expressly state otherwise we are not acting as an online auctioneer agent or seller. 
7.2 We allow private individuals to browse offer swap buy and sell items or services of a non-commercial nature which are in keeping with the general principles of this Site and which are do not form part of any commercial operation.
7.3 Our notice boards and/or forums are not a venue for individuals or businesses to advertise or in any other way conduct their business or offer their goods and services to users of the Site.  The Site is an online forum that permits members to upload pictures and details of goods they wish to exchange swap or sell. 
7.4 Please do not assume that the offer sale or purchase is valid or legal simply because it is listed on our Site.
7.5 Only items or services with a maximum aggregate value of £200.00 may be posted on our Site.
7.6 We do not at any time claim title to or take possession of any items listed or sold through the Site.
7.7 We do not become directly involved in any transaction between users and do not act as agent for either party.  Any purchase of products on the Site shall be directly between you and the other user.  In no way shall we be liable for any such products and we do not make any representations or give any warranties in respect of such products or any failure by the sending user to supply goods to the recipient user or damage occurred in transit.
7.8 We provide no warranty as to the quality of any services offered on this Site which are not provided exclusively by us in the course of our business when we shall endeavour to use all reasonable care and skill.
7.9 You accept sole responsibility for your actions under applicable local law and the legality of any Site content that you may list or upload onto our Site.
7.10 You will not hold V&R Publishing responsible for any loss you may incur as a result of other users’ actions or inactions including things they post
7.11 Much of the content posted on our Forum is created by members of the public.  The views expressed are theirs and unless specifically stated are not those of V & R Publishing Limited.
7.12 Although we will attempt to keep all objectionable messages off our forums it is impossible for us to review all messages. All messages express the views of the author and the author alone.  Unless specifically stated otherwise the views expressed are not endorsed by this Site and we therefore exclude all liability for any posting or any views that are held by others.  We cannot be held responsible for the content of any message or posting uploaded by any user whether authorised or not.
7.13 By using our Site you warrant that you will not post any messages that are obscene vulgar sexually-oriented hateful threatening or otherwise in violation of any law.
7.14 In the interests of good Site management we reserve the right to edit move or remove temporarily or permanently close any thread for any reason in our absolute discretion.
8 Competitions
8.1 By participating in a competition you agree to be bound by the competition rules and any other applicable rules which may apply to the competition from time to time.  Our decision is final in all matters relating to any competition held by or promoted on our Site. 
8.2 We reserve the right to disqualify any entrant and/or winner of the competition. 
8.3 Where expressly stated no purchase may be necessary to enter a Competition. All prizes are non-transferrable and no cash or credit alternatives will be offered. Arrangements for the fulfilment of prizes may be made by a third party sponsor.  All entries must be received in advance of the specified deadline for that Competition and late or incomplete entries will be automatically disqualified.  By you entering a competition you permit us unlimited access with fine or payment to you to use your name and/or likeness for all advertising and/or future promotional purposes.
9 General
9.1 Nothing in the Terms shall be construed as establishing or implying a partnership between us and any user of the Site nor shall any relationship of agency be implied.
9.2 We shall not be liable for any of the following losses or damage whether such damage or losses were foreseen foreseeable known or otherwise including but not limited to loss of data revenue anticipated profits business opportunity goodwill or injury to reputation losses suffered by third parties or any indirect consequential special or exemplary damages arising from the use of this Site and regardless of the form of action
9.3 We will seek to ensure that the Site remains fully operational except during those times when we may be required to undertake maintenance work or provide updates or improvements to the Site or at any time when you are unable to access the Site as a result of technical issues beyond our control and when access to the Site may be limited we assume no responsibility to you for any times when the Site cannot be accessed nor accept any liability for losses which you may suffer as a result.
9.4 Unless otherwise explicitly stated all notices sent to us must be sent by Special Delivery or other such registered mail to our registered office and marked “FAO The Managing Director”.  Notices to you will be sent to the email address that you provide to us when you first register with the Site (receipt of which is deemed 24 hours after an email is sent unless we receive notice that the email address is invalid) or by any form of registered mail or by first class post to the postal address that you provide to us when you first register with the Site.
9.5 The Site is intended for use by and is directed solely at private individuals accessing it from within the United Kingdom and Northern Ireland. We make no representation that any products or services referred to in the materials on this Site are appropriate for use in or are available to purchase via this Site for persons accessing the Site outside of the United Kingdom and Northern Ireland.
9.6 The Terms set out the entire agreement between you and us. They supersede any previous express or implied agreement or understanding whether written or otherwise.  All disclaimers terms and conditions as set out in these Terms or contained within the Privacy Policy (and other policies which we may publish from time to time) shall form part of the Terms of use of this Site.
9.7 We may assign the contract under the Terms or may sub-contract the whole or any part of it to any other person firm or company.
9.8 Failure by us to exercise or delay in our exercising any right or remedy under the Terms shall not constitute a waiver of any of our rights and remedies under the Terms.
9.9 The Terms and your use of this Site shall be governed by and be construed in accordance with English law and any disputes arising under the Terms shall be subject to the exclusive jurisdiction of the English courts.
9.10 If part or all of any term shall become void then it shall be severed and deleted and the remaining part of the Terms and the other provisions on the Site including the Privacy Policy (and other policies which we may publish from time to time) will remain valid and enforceable.
